Decree 417-2018, a Magic Word for improving the business environment

Long awaited, the government decree 417-2018 has just been published this May 11 to fix:

  • The exclusive list of economic activities subject to authorization (100 activities),
  •  The list of authorizations required for the realization of the projects (143 authorizations)
  • The list of activities for which the authorizations to exercise activities have been canceled (27 activities),
  • Simplifications and clarifications in Entrepreneur-Administration relations.

A block of 221 pages in the list of the longest legal texts in the history of Tunisia, but a magic word that will facilitate the task of professionals, entrepreneurs and administration through a compilation in one and unique support, conditions, documents, procedures, deadlines and legal references of activities subject to authorization

The great challenge in this decree that we have synthesized in the link below, weighs on the Tunisian administration which will be obliged starting from the 1st of  July 2018, date of entry into force of this governmental decree, to apply a new rule in its processing of authorization requests namely "Silence is worth acceptance" while its silence until then was worth a refusal without even justifying it. A step forward in the facilitation of business in Tunisia, which will decipher the vagueness surrounding the exercise of several activities and give a more serious image for the restart of a major lever of growth namely investment.

This government decree must evolve in the direction of a gradual removal of other activity authorizations but also shortened response times of the administration that will oscillate between 60 and 180 days. Delays considered too long that are no longer tolerable once the administrative machine will unjam and will start. It was time!
